1. Acceptance of Terms

By accessing or using ClaroCam, you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree, please don't use the service.

ClaroCam is operated from Canada and complies with Canadian law. By using our service, you consent to the transfer and processing of data in accordance with these terms.

2. Service Description

ClaroCam is a visual AI identification and analysis tool that uses artificial intelligence to identify objects, plants, animals, vehicles, products, and more from photos and video frames you provide. Features include single-photo scanning, multi-angle video scanning (hold-to-capture), community feed sharing, user profiles, and specialized AI modes for various categories.

Additional features include:

• AI Chat & Follow-Ups: Text-based conversations with AI about scan results or general questions. Pro feature for in-section follow-ups.
• AI Image Generation: Sketch-to-render and "show me this fixed/built" visualization using AI image models.
• Games & Puzzles: AI-generated visual puzzles (Spot the Difference, Zoom Quiz, etc.) created from your photos.
• ClaroTrack: Photo comparison tool to monitor changes over time (construction, health, projects).
• Workforce Safety: Team-based safety inspection tools, toolbox talks, digital sign-offs, document management, and compliance reporting for enterprise subscribers.

3. Account Registration & Security

You may need to create an account to access certain features. You are responsible for:

• Providing accurate information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of unauthorized access

You must be at least 13 years old to use ClaroCam. If you're under 18, you must have parental consent.

4. Acceptable Use Policy

You agree NOT to:

• Upload illegal, offensive, or harmful content
• Upload images containing child exploitation material (will be reported to authorities)
• Reverse engineer or attempt to extract the underlying AI models
• Use the service for automated/bulk processing without permission
• Circumvent usage limits or payment systems
• Harass, threaten, or impersonate others (including in community feed comments)
• Post spam, misleading, or inappropriate content to the community feed
• Upload viruses, malware, or malicious code
• Use the service for spam or phishing
• Violate any applicable laws or regulations
• Create fake accounts or manipulate community engagement metrics

We reserve the right to suspend or terminate accounts that violate these rules and remove community content that violates our guidelines.

5. Subscriptions & Payments

Free Tier: Limited to 5 scans per day. May be subject to reduced features.

Paid Subscriptions: Billed monthly or annually. Prices are displayed before purchase. All payments processed securely through Stripe.

Cancellation: Cancel anytime from your account settings. No refunds for partial billing periods, but you retain access until the end of your paid period.

Refunds: If you're unhappy within the first 7 days of a new subscription, contact support for a full refund.

Price Changes: We may change subscription prices with 30 days notice. Your rate locks in when you subscribe.

6. Intellectual Property

Your Content: You retain all rights to photos and video frames you capture. By using ClaroCam, you grant us a limited license to process your images and video frames for the purpose of providing the service. We don't use your photos for training AI models or marketing. When you share content to the community feed, you grant other ClaroCam users a non-exclusive license to view that content within the app.

Our Content: ClaroCam's design, logos, AI responses, and underlying technology are protected by copyright and trademark. You may not copy, modify, or redistribute them without permission.

AI-Generated Content: AI responses provided by ClaroCam are informational only. You may use them for personal purposes but cannot claim copyright ownership of AI-generated text.

7. Disclaimers & Limitations of Liability

ClaroCam is provided "AS IS" without warranties of any kind, express or implied.

We specifically disclaim:

• Accuracy of AI identifications (AI can make mistakes)
• Completeness of information provided
• Fitness for any particular purpose
• Uninterrupted or error-free service

Critical Safety Disclaimer: Never rely solely on ClaroCam for safety-critical decisions (identifying venomous animals, edible plants, medical conditions, structural safety, etc.). Always confirm with experts. We are not liable for injuries, damages, or losses resulting from reliance on ClaroCam.

To the maximum extent permitted by law, ClaroCam's total liability to you is limited to the amount you paid in the 12 months before the claim, or $100, whichever is greater.

8. Indemnification

You agree to indemnify and hold ClaroCam harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any rights of others
• Content you upload

9. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date.

For material changes, we'll notify you by email or in-app notification at least 30 days before they take effect. Continued use after changes means you accept the new terms.

10. Account Termination

By You: Cancel your account anytime from settings. We'll delete your data per our Privacy Policy.

By Us: We may suspend or terminate accounts that violate these terms, engage in fraud, or abuse the service. We'll provide notice when possible.

11. Governing Law & Disputes

These terms are governed by the laws of Canada and the province of Ontario, without regard to conflict of law principles.

Any disputes will be resolved through binding arbitration in Ontario, Canada, except for small claims court matters or intellectual property disputes.
